    dear sir,
    iam employed in my company for 2 yrs. on a limited contract,i signed a 4yrs. contract,now my laborvisa is finish and ive decided not to renew it,will i be getting a 6 months labor ban,and can i work or other company may issue a new working visa.

    Hello Deepak,

    I have an offer from a semi government company in Abudhabi, but it will take time since they have lot of security checking formalities. ( I dont know realy how much time it would take) Mean while if i join another company will it be impossible for me to switch to the former employer ? Please reply me

    have 2 years limited contract, and it will be ended this coming feb, if i will resign on October , should i pay the money for visa cost&cancellation cost? the company since my contract is not completed yet that time? and, are they going to give me the free ticket and other benefit
    Please help me and i will need the answer asap please…

    Greetings!
    I am working here in Al Ain, Abu Dhabi for almost 4 months, my visa title upon entering is “agriculture worker” but when I arrived here they put me in office and working as office clerk and receiving basic salary amounting to AED 1,100 plus 200 allowance. My manager told me I’ll undergo for 6months probation period. Even if they increase my salary after my probation period, Question: do I have the option of not continuing my contract? after 6 months if I found a new company offering much higher salary, is it possible to transfer? Anyway I am a graduate of Computer Science in Information Technology.

    A sales man resigned from company after 3 years of work because he has established his business under the name of local. (he had power of attorney in full) But (1) he didn’t obtain NOC from his employer at present. (2) he has not cleared his loans to customer (credit sales on his guarantee)
    Q: Do employer have the right to ask MOL to ban him for 12 months as he will damage the business of employer by using old contacts?
    Q: Can he be legally sued for going a business without prior NOC from Company?
    Please do advise in view of labor law at UAE.

      Mohammad,
      Yes it is illegal to go for his own business when you are already working for one establishment. Employer does not have any rights to impose any ban without valid reason.
      Company can not sue without proper grounds of violation.

    Dear Deepak,

    I have resigned from my company, i have dubai visa, and my ex-company has computed my leave salary payable in final settlement on basic instead of full salary. I have refered UAE Labour Law and as per section 4 Article 79 it should be on last drawn salary.

    Advice will be really helpful as to what is the legal way.

    I need your help please. a Colleague of mine has made a car accident. She rolled the company car going from work to her home. We live on the company premises.

    The company now says they have only 3rd party insurance on the car and she must pay the excess amount which will possibly be thousands of UAE Dirhams. We don’t have this in our contracts. The police report also states nothing about speeding or anything wrong she has done. It was an accident and she got hurt and are still suffering a little.

    Can you please tell me if the company can do this!

      Seems you may need intervention from MOL if the company is not agreeing to bear the costs. This seems to be a legal matter and you better approach MOL helpdesk.

    Upon 6 months probation and the company terminated he/She appointment. And the two parties are in a good relationship and the company promise to transfer he/she visa to any organization related to his previous job. Will no objection certificate help to prevent bans on he/she visa

    Dear Sir,
    I am working in elite security services L.L.C, and Month of June-2014 and July-2014 salary still we did not get and third month is running.
    Sir I need salary on time, and I have a lot of responsiblilities food for me and my family and education my kids and my parents food and medical treatment money at each month.
    since i Join this company continues i am facing same salary delayed issues.
    if company cannot give salary on time they must give us release and time to get unother job.

    Im already turning 11 months in my company and i applied for maternity leave. I was informed that since I’m less than a year I will paid 50% of my basic salary only. Housing allowance will not be provided as per them. Kindly advise.

    Sir good day,Ive worked in llc comp.for 10months with unlimited contact I already resign but still they are not yet process my visa cancelation unless we pay them we have agreement breach of contract which is 3900dhs its too much we cannot pay them.we go to mol and they said its illegal to pay comp what to do sir.we don’t know where to place ourselves,all I want is simply going back to my country,I reserve my money to buy my own ticket fare.hope you reply sir,thanks

    I am working as a secretary in Dubai. Its been two months now.My salary is 3500dhs. I Had signed and given the paper for the labour card, a month ago. But not received.

    well, i got another job in Dubai for a salary of 5500 dhs. I really want to resign from this job.Will i get a work ban of 6 months??? I am on my husbands visa.

    how are you? it’s been a long. actually i have one Query!
    i already changed my profession in Contract to Computer Programmer, it was Administrative Supervisor before,
    then i gave the documents to typing office for visa renewal, but when in the visa approval it’s still Administrative Supervisor,
    i asked them, how it happen? they said sometimes the emigration make mistakes,
    but i have strongly doubt on the typing office that they made mistake.
    they said submit the passport and document to empost (now they are doing emigration services), after getting the visa this typing office people can change my profession, but i have to pay again 250 AED.
    i want to know,
    1. is it possible after stamping the visa, can we change the profession?
    2. if the profession in labor contract & visa is diffrent, then is there any problem for applying family visa?
    3. was this mistake from typing office or emigration?
    please help me!!!

    Hello Sir, Hope you’re doing good. I am a registered nurse working in a hospital, worked for 3 months and one week, decided to resign because of heavy work load and bad management, HR told me I need to pay them 7500.00 AED and work ban of 6 months here in UAE. My question is, do I need to pay them and follow the imposed ban of the hospital, please help, thank you

    i have signed my contract for unlimited period with a manpower supplier for one of the oil and gas company. Now consultant is telling that we can pay salary only after your security card prepared. i have signed my contract on 28th april. my employment visa stamped on 8th may. i have spent almost one month without salary. so should i demand salary from 28th april or from the date of visa stamping. still i have not been located to site due to security card under process.

My question is that is eligible for the maternity leave from my company, if they are not paying me what step should I take to get my leave benefits and as well maternity leave.

    Hi sir i have 2 yrs contract unlimited and now i find a new job. I find semi government. I need to file a one month notice before i leave or not? Because im working here in my present work is 12 hrs a day and once a month off. and i can file complain if ever she cannot release me? Im already 10 months here

    I am working as a IT technician here in abu dhabi since 2008 with unlimited contract, they renew my labour card last september 2013, i resigned last month and my last day is last march 31, 2014, .. my question is, can they give me ban for not completing 1yr in in my renewed labour card.     Good Day!!!

    Just want to ask. I am currently working as an Accountant here in AUH with unlimited contract (2 Years ) having a basic salary of 4000. Will be on my six month this March. I wish to apply on any Government offices or Free Zone private companies after finish my 1st year on my current company. Would there be a possibility of labour ban if I had an offer for Government offices or freezone companies lower than 10000 dirhams? I am a bachelors degree holders. Will my current company issue an immigration ban since I did’nt finish my contract? Or what are the possible consequences?

      you may get labour ban but no immigration ban and labour ban is not applicable to any govt organisation or freezone.

    i am limited contract expiry august 14, my company wants to change my job from manager to low position, can i complain to labor. and what about company timing some times i am 15mins late they cut salary, my child is sick i want to take hospital they dont allow, i am sick they ask for certificate, and not giving insurance or money for health

    Dear Sir,

    I would like to ask, I am on limited contract as development Manager, expiring in 9 July 2014, my company is putting all Market outstanding on me and forcing me to pay monthly basis from my salary, secondly they are also forcing me to do another job, below my designation as company sales is going down.
    My question is: 1- am I liable to pay company for market outstanding, where I have only brought clients to company.
    2- can company reduce my salary and ask me to change my seating place and work as lower designation.
    3- can I file a complain with Labour for all this above or wait till my contract expire or company terminates me, for smooth cancellation.

    Dear Sir,
    I have a Problem from my company now i already submit a resignation LETTER but he approved it verbal the Problem now is when it already 1 month from my Resignation he didn’t allow me to move in my new company i already finished 3 years and renewed my contract in the Same company for 2 years i already finished 1 and 11 months for my second contract will i be banned if i insist to go from the new company he said if i insist i will Not get anything from the company i already have an offer LETTER from the new company im in limited contract my salary is only 2500 under follow clerk Position and the new company only offer me 3,000 under accounts assistant Position
    I have attested Bachelor Degree diploma what can i Do? can i resign anytime ? Do i have a banned? can i get my gratuity from my second contract ?

      since it is a limited contract and you are not completing the contract period company has the right to not to process your gratuity. You may get ban.

    I am working in hotel since 5 month. I heard its no ban, one of our staff she has band from previous company also that she is working in hour hotel, I have listened from every body our visa status is emigration not labour visa. My contract is 3 years. If found other job can I leave company? Will I have band or no? What is different between labour or emigration visa ? Till when I need to work in company for no band?

      if they open a bank account it doesn’t mean that company will pay you on time. It will be depend on each company and its policy. It is right of an employee to receive salary on time. If they are not then they can approach MOL and address this issue.

      If you are not getting salary payment on time you can approach to MOL and address this issue. For sure they will help you out.
      If you leave the job now then you may get an automatic labour ban for six months.

      If you are not getting salary on time or not receiving benefits mentioned in your agreement it is better you approach to the MOL for solution.

In case I will resign my current employment prior expiry of my visa then please guide me whether I will loose my final benefits which i will be entitle to get on expiry of my visa means termination of contract on expiry of visa or it will be paid to me in prorate in case I resign prior expiry of my current visa.

I got an offer from a free zone and I want to resign from my current company but my employer doesn’t want to cancel my visa because the reason I gave him is that I wanna go home to our country, he told me he is going to cancel my visa after 5 months, what is your advice on my situation?     i am there now is 2 month.
    but because is still new.we work part time not full time as it was supposed to be.then they pay us half salary.but is not our problem the probleme is about the owner of company who dont have customer
    and we do even the work we are not supposed to do.my question is if i resign will i pay back they money?will they burn me?

    Hi,
    I was trying to find thr rule in case of a mistake I have done. I work for a travel agent and issued group tickets in credit. The thing is I did it while in leave as I got a big opportunity and the company was pushing us hard to increase sales. Due to my unluck the party has not paid back in full. The party gave some money and a passport for guarantee. The party needs more time to arrangr the money due to some payment delay. My company gave me the ultimatum for 3 days to pay the money else will file a case and put me in jail. I dont know what to do. They think I did fraud. Is therr any rule I can use to get more time from the company? The amount is 50 times my monthly salary.

    Hi Deepak, my visa status is quite confusing & I knew that my current employer cheated me. This is how started at all, I join in one of the Group of Companies here in Abu Dhabi last 19th Sept. 2013 however, my visa has been released on 16th March 2013 and take not, this is NOT an EMPLOYMENT VISA a but a PERSONAL VISA instead (under the sponsorship of the owner). I’m an Accountant by profession when I came here in 2008 but right now the current profession that the owner put on my visa is a “COOK”. My questions are:

    1. If I decided to resign and transfer to other company am I iable to Labour Ban since I did not completed 2 yrs.of service?
    2. Can I make this opportunity to file a formal complaint to the Ministry (Labour) against the owner for NOT giving me a valid visa?
    3. Are those employee who are under personal visa also entitle to gratuity pay or whatever benefits like an ordinary employee with employment visa and what will be the basis of the computations?

      if they terminated you for no valid reason, they should pay you 3months of your salary. and if they didnt send you a 1 month notice for termination, that is additional 1 month salary

    Actually my case is little different from others.

    My Visa still valid but as per my contract date from 11-Nov-2010 it has been finished on 10-Nov-2013. And the VISA Date is 01-Jan-2014.

    So issue is that do i have to work with them until my visa valid.

      Since you are on probation and you are not happy you can resign ….but if there is pressure from company you can take this matter to Ministry of Labour . They will help you out.

      It is not easy to switch a job . If you resign you will have an automatic labour ban for six months from MOL. If you want to join other company you should have a release from your current company

        Good day sir, i just want to ask if its possible take my full contract if the company is going to close, i joined the company 21 of april 2009 and i had finished my 1st contract, my second contract is going to finish this coming 16 of May 2014, the company gave me termination letter 1 year ago and the reason is the same (which is the company is closing) yet im still working for the company b’coz closing is always postpone and this coming end they said this coming end of march the company will close and its final. is it possible to ask the company to pay my remaining salary for the month of april and may?

    i just have an important question. i was offered a new job so i resigned from my present company, i’m still waiting for my visa cancellation when my new company called and informed me that they cannot process my visa as the labour department cannot grant visa as females are not allowed to work on the port area. please what can i do? i resigned already and i was confident that they will process my visa but this is what happened? please advise. what can i do? can i complain?

      If the ladies are not allowed to work in port area how can the company give you an offer?
      You need to find a new job or if your previous company not cancelled your visa you can request them to hire you again.

    Hi Dear, , i am serving in a company as a sales executive. i have a limited contract of 2 yrs. i have completed 15 months. i applied for annual vacation after 12 months but my vacations were cancelled by saying another sales person is going on vacation. so i applied 1 month vacation again after 15 months of continuous service but was again refused by saying the sales are not up to the desired level.
    i was also asked to pay AED= 9000 / – as a loss to the company for a product which could not be sold due to short expiry. For this product i tried my level best to sell to other customers but they rejected due to short expiry. I have the documents of proof.
    I do not feel comfortable working in this company.I feel lots of mental torture and feel insecure. My Boss deducts salary for unjustified reasons,
    kindly guide me what is my position and if i am protected with UAE laws ?

    i have a question on Date of Joining in a company. My friend joined a company in the month of April but her visa was stamped in Sep. The company has now informed her that as per rules her joining date would be in Sep and not Oct. All her calculation, gratuity and leaves will be calculated from Sep.

    Could you please advise whether the joining date should be Apr or Sep

      I guess it should be from April not September. Ask your friend to keep the record of payslip or salary statement from the bank from April. your friend may need to show her employer while calculating her gratuity when she leave the company.

    Sir,

    I am recently join one reputed Est. that agreement is low my contract is as a Sales Rep. Basic is 1000/Dh, Transport & Accommodation allowance 1000.00/Dh How is possible according UAE Law firmissued visa.

    Then Due to five month may I not get salary complete according my contract even salary not proper issue for the Bak. WPC when I told
    every month pay my salary as per contract but he give every month less then my salary.

    Due in this problem however solved also I request for NOC but
    he told spend visa cost asking as per verbal talk and I having
    struggling and account of poverty due to low agreement put signature .

    I ask the question is however the labour law is allowed and issuing low agreement for my position probably past five month
    labour officer not wishing our company.

    so kindly request give advice however relief and any without band
    I want transfer visa any other company for most respect Dubai labour firm and how can approaching to the in this regarding.

    Please help in this

    can you please confirm me i am working since march 2010 to till now.i give one month notes period to the company and the company took all charge /property from me butt dozen accept my resignation,they told me we are not accept your resignation until you can not finish the projects.i send resign by email to. is it by acceptable by law or no.
    second think all charge or company property hand over to company in writing. i have all in writing copies with so pls advise me because i have an anther job offer in free zone company

      If you have an attested certificate and new salary as per MOL slab you can avoid ban.
      But if your contract is limited you need to complete the contract period before joining the other company.

      Since it is limited contract you need to complete your contract period . If not company may ask you to pay the compensation for not completing the contract period and also you wont be eligible for any gratuity.

      It depends on company. Some companies ask visa expenses from the employees. But it may be against law. Company cannot deduct any visa charges from employees. yes you may have labour ban. Since your new company is in freezone ban won’t be applicable to you.

    i am working for a free zone company , after completion of 8 months service i submitted the resignation . On company request i served 2 months notice period. in final settlement they are showing the deductions
    1. Medical Insurance remaining period.
    2.Visa cancellation expense.
    3.Losses incurred by company due to untimely termination of contract by employee.
    and they are saying about article 116.
    Please advice me what is the process i have to fallow.

      Yes in this case you will have to go as per company decision .
      Usually medical and visa expenses are not deductible from the final settlement.If you are not comfortable with the company decision you can go to the freezone authority and get the update.

      There is no fees for ban lift. You need to finish your contract to avoid ban. Otherwise you will have an automatic labour ban. But in case if you get job and salary which is as per MOL(www.mol.gov.ae) slab then you can avoid ban.

    i work for a company with a limited contract of 3 yrs. but on my 8 month i resign due to some personal family reason and need to go back to my country. i have completed 1 mo. notice only due to i make it as a emergency resignation though i signed a contract of 3 mos. notice. reason for them not to give my last salary, 20 days leave pay, 8 mo. pay. due to not following the 3 mo. notice. i have completed all the clearances return all company belongings including i.d dated august 1. i have book my ticket august 14. august 7 the company called me and says cancel my ticket because they can not released my passport on that flight date. i already cancel my ticket and again waiting for their call. they are also saying that they will require me to go to embassy to sign a labour bond but until now i am not receiving any call from them. what is the standard number of days in visa cancellation? is it really just not to received any amount from the company? i can not stay here any longer because i am financially drained already. i just want to go home the soonest. what should i do? advice please.

    hi ,am working in Prime Automatic Laundry since i have been working there is one year and 3 months.Now they terminate me from working at Prime Automatic Laundry but they didn’t finish my cancellation .i received 2 warning later and 1 termination later and my unlimited contract is 2 yrs.

I talked my Boss Last day and he’s willing to Release me. Because our Small Workshop is not taking any Project that’s why our salary is always delayed. He said to me if i found new jobs and the salary is good i can go anytime and he’s wiling to help me to find new job. My question is, Somebody Interviewed me and he said there is a labor law 2013 , that they will not allow to leave the company or est without 2 years of stay. so what i will do if there is no salary? how can i survive? my family are defending to me. so if he will released me there are still ban for me? or depends on my boss if he will put me a ban?

      Hi Mhar, Now a days rules are very strict. company cannot delay salary without any proper reason. Since it is controlled be WPS WAGE PROTECT SYSTEM Labour department has all the information. If in any case company is not paying you a salary you can go to the labour department and complain. In this case labour ban will not be applicable.

    Hi Deepak. i hope you can help me by replying as soon as possible. I have spent 9 months with a company in abu dhabi. They have offered me to resign or the position will be made redundant. I have unlimited contract. if i resign they will pay me for 3 months notice period, but if i choose not to resign, they have said they will make the position redundant and will still pay me 3 months salary. Should i resign or be made redundant ?

    I’m new here in Dubai and I’ve been working since March 28, 2013 as Call Center rep. But still didn’t received my salary, also i’m not the only person who’s not getting paid some employees are not getting the salary for 3 months and some are 2 months.

    Example: Facilities Manager, Supervisor’s and more than 10 Field personnel.

    Can I apply for a new job without getting the 6 months banned?

    I already have my employment visa but still didn’t take the medical exam for the residential visa. Also can you please advice, my contract is unlimited the company.

      Hi Aia,If your contract is limited then you need to complete the contract period.If it is unlimited you can resign since you have completed more than one year in the company.

    My visa is only 1 year of my residence visa uae driver’s home
    And the job of trainer in a gym to gym and now here I am getting a good job in the second visa I want to cancel the vise then I will not have any restrictions
    Visa has no owner and no gym owner and both are friends
    Visa’s owner says you can put a ban on lifetime
    Maybe something like this possible?

    Hi. I finished already my 1st contract of 3yrs under limited contract. I renewed my contract but it’s only 2yrs and its unlimited contract now. The question is,im on my 4th yr now if i will resign, will i have a labor ban if i finished the 1st contract? Thanks

    Hi daniel here, i have finish my 3 year limited contract in the private hospital i am working for. After my visa cancellation, do they have the right to keep/hold my passport or i can take my passport within me because i still have 1 month to stay in UAE from the day of cancellation? And what can i do if they still dont want to give my passport back? And what article in the labour law supports about passport issues. Thanks

        Hi Daniel, Normally they will give you the passport on your leaving date…There is nothing mentioned in labour law about the passport issues. No employer can keep passports. However, due to certain strategic and security reasons, employers do keep the passports.

    Hi, i have a doubt , i am working in a private school, my contract 2 years, i wont like to renew my visa, because the school management is not moving as a professional way, they are treating partiality of nationalities, salary also based on there nationalities, its very bad here. after my 2 years according to the labour law flight tickets they will provide, they said will not provide u, will not increase the salary, these problems can i complaint to the labour office, they will give help us or not?

      Hi John, about salary increment you cannot go to labour.but regarding flight tickets if it is mentioned in the contract and company refuses to pay then you can go to the labour.

    I have moved to the UAE and currently on a Tourist Visa. I have been offered a job as a Teacher at an international School. Is the school legally required to include a flight home and rental assistance? Or is it true that there are two different type of contracts?

    Hi! I’m currently working in freezone for less than 3 years. My company would like to terminate my contract as they need to minimize the expenses. Now, they ask me to submit a resignation letter. They mentioned that I would not get anything if my contract will be terminated. Please advice.

    hi im working in furniture company but our shop close in abu dhabi and there is branch in dubai the problem is we cannot absorb in other branches and the management gave us a closure letter to find another company, the management said the branch in abu dhabi is no file in labour because the name of the branches is different but same company,i work there about 1yr and 2months my visa is unlimited,,it is possible having ban or no? thanks alot

    But I have CIMA (UK)
    Chartered Institiute of Management Accountants (UK) membership
    Hence in India I was considered as a professional
    I have not completed 2years
    If I resign
    Will there be a ban?

    i have completed 4 month in my current organisation,i am planning to leave after i have completed 1 years,i am on my husband visa,and my labour card contract is for 2 years.if i leave after 1 year do i need to pay some amount to company,and will i get the gratuity .

      Hi Samira, No you are not supposed to pay any amount to the company unless you have signed for such a clause in the employment agreement. Yes if you are completing one year in the company you are entitled for gratuity.

    I’m under unlimited contract and I’m working as Sales Staff. My visa is valid from Dec 2011- Dec 2013 But our showroom branch (only the branch and not the company) is got closed for some reasons, and our management gave as release. Now, I found a new job. I just wanna ask if i still have ban even they gave us release? and it is possible that my new employer can give me a new employment visa?? thanks

        i still have ban? because our management told us that even our shop was closed we still have automatic 6 months ban.. But I’m wondering because its not really our fault . We are all willing to finish our contract but for some reasons they have to close the branch. Because I’m really worried about it maybe my new employer cant provide me a new visa..     Good morning. I want to ask you some questions regarding Labour ban. I am currently working for a Contracting company in Abu Dhabi as an Accountant General under an Unlimited contract from past 7 months. My company have hired me as per my B.com degree qualification. This is my first job in the Gulf. I am looking for a job change. I have read earlier in Khaleej Times Legal View that there is no ban if an employee works for a year. However, I checked with Ministry of Labour Abu Dhabi Office and they told me that they have not come to know about anything as such and there will be a ban if an employee leave the job within 2 years of employment. My questions to you are;

    1) If I get a job now, will I be able to switch to the new company without a labour ban. If NO, then can I revoke the labour ban by paying fees to the MOL.

    2) If my new company hire me as per my SSLC/High School attested certificate with salary package of 5000 AED, then can I join the new company without a labour ban?

    3) Also, since my current company have given me Accountant General position and if the new company gives me a lower position like Accounts Clerk/Accounts Assistant/Sales Executive if they hire me as per High School certificate, will there be any problem for visa processing?

    4) Are the Dubai Labour Law & Abu Dhabi Labour laws different?

    Please clarify and advise me on the above mentioned questions since I am searching for the answers to these questions from a very long time. Your help in this will be greatly appreciated. Thank you.

      Hi Hanaa, you cannot pay any amount to lift the ban. However, there are multiple views on this and entirely depends on the department. If you find a job at FZ companies, it will be better as there is no system of ban there!

    i have a friend who currently working in a restaurant as general cleaner.and this february 18 he is one year in his job .but in his contract it says unlimited..and the only date stated in the contract is the day he started to work feb.18,2012.,and he is going to resign next month,should the restaurant oblige to give gratuity to his employee?

I was working in consulting company based in bahrain, but unfortunately the company here in Dubai is inactive already since august 2012, no WPS no transaction at all, but I am still under their company visa until present. Now, I applied in new company, but this new company giving me a salary only 4500 AED, In my case if i will change my visa am i going to have a 6 months labor ban?     Hi, labour card is expiring this june while my visa is on July this year. If I get an offer below 5,000 and not in a freezone, how much will it cost to lift the ban. Will my ban be still 6mons or less since I only got few months left before my visa expiry?

    Also, can you please clarify if a new company offers me 5,000 is my ban lifted? or are there any other fees to be paid? Do I aso have to pay anything to my current company for not finishing my contract/

    i am working as sales lady in uae, im receiving dhs1,500 per month and dhs300 as allowance, accommodation is not covered and we r working almost 13hours a day (split timing). they r giving an 1day per month off day, and 1day absence will be a dhs100 deduction for us, even if having a sick leave letter from a doctor it is still noted as absent.
    isn’t it too much??? what can we do bout this?

      As per UAE Labour Law there is 15 days paid sick leave per year ( if you have proper medical certificate). if you are facing any problems you can go to the labour department and discuss this issue . But please check your employment agreement for timings and salary and other clauses for what you have signed for.
