In the past few months, I have been contacted by many desperate employees who have been wrongfully been listed as absconding although they were very much here in the UAE and in regular contact with their employer. My reply to these individuals was always to approach the Labour Court in the Ministry of Labour.
Today my faith in the justice system in UAE Labour courts in reinforced. If you have read today in Gulf News, there is an article about employees who won disputes of absconding which were wrongfully applied on them by their employers. Although UAE Labour Law does not mention about treatment of absconding, MOL is very clear on aspects about when and how an employee may be banned.
An absconding case is filed when an employee can not be traced by the employer. But most of the time, companies out of jealousy that their employee is leaving them after obtaining experience, lists them in ‘Absconding List‘ as a revenge. This usually happens if the concerned department is manned by unprofessional individuals who fail to look at a bigger picture.
