UAE Labour Law encompasses all the rules and regulations with regard to the laws related to the employment in the UAE. Everyone who is employed in UAE should make it a point to read this law to understand their rights, their employer’s right, various laws on gratuity calculation in UAE, dispute resolution and so on.

I believe that the UAE Labour Law is prepared by Ministry of Labour to protect the rights of the employees as well as employers.

    actually sir my previous contract is already finished which is three years and i just renewed it for another two years and the length of that is until May of 2015, i have given already my 1 month notice to my company and yet they’re that i need to pay something like a refund and it seems quite unreasonable. i only want to know if that is under the labour law?

      No. Companies can not ask for refund if you have not agreed through a written contract.

    Thanks for the reply. What do you mean by arbitrary termination? Does it apply for below a year of service? If i will file a complaint at MOL and ask for additional compensation, will it be granted? Thanks!

    hi sir this is andy. i’ve been in my company for 4/2 years and now i’m resigning because i need to go back to my country for some important reason for good but my company told me i have to pay them for not completing my renewed contract. is that reasonable? i am unlimitted by the way. thank you

      Andy,
      I have not understood your length of service.
      If you have completed your contract, employer should not request any refunds.
      Further, it is illegal to ask for refunds from employees unless it is clearly mentioned in your contract.

          This is against the law. You may approach MOL with your query.
          Make sure your offer letter is clear about these.

    Dear Deepak,

    Good day!

    I have worked for 10 months on an unlimited contract. I was terminated and had been given a 30 days notice. The reason of the termination is that the company is re structuring. What must i expect from my final settlement? Will i be compensated for the termination?

      Since your length of service is below 1 year, you will not receive any gratuity.
      However, company should provide you termination benefits.

    mistake and ended up financial damages to company during duty is employer entitled to deduction this amount from my gratuity if they fire me please reply am in stress

    I work as a secretary in the perfumes company, last here since I start working here, this is my 2nd time of ramadan here, i just want to ask the 6 hours less in ramadan taimings is mandatory? because we work 8 hours everyday

    Dear Deepak,

    Good Afternoon. I want to ask you some questions regarding Labour ban. I am currently working for a insurance company in Abu Dhabi and i signed contract with outsource recruitment companies as sales exe under an Unlimited contract from past 3 months. My company have hired me as per my degree qualification and they offered me 4000 AED monthly salary. This is my first job in the Gulf. I am looking for a job change. I have read earlier in Khaleej Times Legal View that there is no ban if an employee works for a year. However, I checked with Ministry of Labour Abu Dhabi Office and they told me that they have not come to know about anything as such and there will be a ban if an employee leave the job within 2 years of employment. My questions to you are;

    1) If I get a job now, will I be able to switch to the new company without a labour ban. If NO, then can I revoke the labour ban by paying fees to the MOL.

    2) If my new company hire me as per my SSLC/High School attested certificate with salary package of 7000 AED, then can I join the new company without a labour ban?

    3) Also, since my current company have given me as sales executive position and if the new company gives me a lower position like Clerk/Sales Executive if they hire me as per High School certificate, will there be any problem for visa processing?

    Please clarify and advice me on the above mentioned questions since I am searching for the answers to these questions from a very long time. Your help in this will be greatly appreciated. Thank you.

    Dear Sir, I have question regarding the ban. I worked in UAE before 7 years . I left UAE 2010. Now I am working with a new company in UAE from Sep 2012 . I have Higher secondary Certificate I did PIC training From Food Control department of Dubai Municipality. Now My Company condition is not good they loss so many contract now company cut the staff overtime for the financial Problem.So I am trying to another job. My question is can I joint another company without ban. Please Suggest me I have no idea about my contract limited or unlimited.Thanking you.

    I already resigned with my company I started to work form October 10, 2010 and leave the company last April 30, 2014.
    My Basic Salary is 2,880. Please let me know how much will I get from my gratuity.

    Am I entitle for a leave salary as I have only 3 annual leave?

    I am currently on unlimited contract and working for mashreq bank in the sales team as sales supervisor and my sal is 5200 AED . i have joined this bank in march6th 2014 now i want to quit the company as i am not interested in sales and have an offer from NMC health care if i join NMC will there be a ban

    Dear Sir,
    I am an enginner working as a adminstration manger for a limited liability company IN DUBAI with 2 years contract.I joined in April 2012,[since 1 year 8 months].I applied for anual leave on Nov 26th 2013 and it was approved.I have a copy of written approved leave application with me.But I could’nt travel since my salary and allowances [WPS system through Al Razooki exchange]have not been paid since September 2012[almost 3 months].Now i am still waiting for salary and allowances and also i have booked ticket for my travel to Mangalore on Dec 15th2013 night.I can’t change my travel plans anymore since my family is eagerly waiting to see me.My employer has agreed to pay all my dues but he has no funds as he has gone in debt and he himself does’nt know when he will have money..Even other employees hav’nt been paid since September2013.My question now is ” Can i go to India on Dec15th for 2 month leave,and collect my dues on my return to Dubai OR can i complain to MOL from India if i don’t recieve my dues by Dec15th?Can i file a complaint to MOL from India if situation becomes worst?plz advice with help uregently sir,

      I dont think you can complain to MOL during your stay in India. You need to be here. Better to collect your dues before or after coming from vacaton

    Sir, My daughter is on Father’s visa and she is working with a company for the last 20 months on workpermit. Now that fahter has been terminated by the Company she is opting for the Company visa.
    If she wants to change her job after few months can she change it or she has to work with the same sponsor till the expiry of her present visa. I mean to say she has already worked 2 years with the same company on father’s visa. kindly explain…

    Hi,

    If the visa type is working on husband’s visa for an IT consultancy for more than a year, shouldn’t the consultancy be offering maternity pay as per the dubai law? The IT consultancy is clearly saying that they dont follow UAE law as they will have to pay 45 days paid maternity leave + 45 days half pay which is outside their budget and rules .

    What should be done in this case ?

    Dear Sir my contract is due this coming Nov 28, 2013 I submitted my non renewal of contact letter to the management last September 10, 2013. Last Oct 14 I had arguments with one of my colleague and inform my supervisor about the matter. I was then advised to report to the office of the same day but in the office, the cluster manager asked and forced me to signed 3 warning letter and a termination letter. I signed this documents out of fear because my manager is shouting at me. I did not hurt anybody physically or verbally. or violate any UAE labor law. I am the one who is filing a complain to my manager against my co worker. My question is, can I do something to reverse my termination. Will I have a ban. Need help. Please advised me what can I do.

    I want to ask regarding Labour ban. I am currently working as Achieve Clerk in a Real Estate company in Abu Dhabi at AED 1,500 salary plus Accommodation. I have completed one year and one month here. I am ACCA (UK) Qualified, I have checked with ACCA Body they do not recognize my this experience in their 3 years practical experience requirement (PER) because no one qualified Accountant working in this company to Sign my experience. Today I have got an offer of AED 5,200 from a big company in Abu Dhabi.
    My current employer allowing me to join new offer because of my future and this Real Estate company is not suitable to me according to my Qualification. I have B.COM (Bachelor of Commerce) degree attested.
    Please Suggest me to finalize my decision regarding Visa cancellation.

    Dear Sir,

    I was fired today. I was working for this company falling under TECOM. I had a unlimited contract. My probationary period was set for 3 months which I had completed. My tenure at the company was 8 months. The cause for termination was not mentioned and neither have I ever received a warning letter in the past or now.

    My question to you is that what am I entitled to ?
    a)3 months pay
    b) leaves that I have not availed on a pro rata basis
    c) Repatriation ticket
    d) gratuity on a pro rata basis since it’s under 1 year?

    All of the above? anything more or anything less ?

    Would really appreciate your thoughts on this.

      if you are a permanent employee :
      1. You should receive notice period salary as mentioned in your contract
      2. Yes you are entitled for availed leave on pro rata basis
      3. Yes you are entitled for one way air ticket
      4. No you will not get gratuity since you have not completed one year

    Hi Sir,

    I’ve been employed for more than a year now. And I wanted to leave my current employer.. I pay a placement fee including the visa amonting 2500dhs in a recruitment agency in.our country in the contract we signed the position mentioned is cashier n the sal
    Is 1500 but wen I came here they talk to.me and ask me to sign a contract they note the position as sales/cashier the salary is 1400 but I have a copy of the contract issued from the recruitment agency in my country.. I wanted to find another job badly but I’m worried that they will ban me and I have no choice I hve to go back then in my country but the problem is I don’t hve enough money to buy for ticket…. thank you sir hope u can help me

    hello sir my name is amit shukla , i came in dubai last moth with a employment visa of a retail company currently i am working as a ast.manager in this company .but the company is not fulfilling his words what the hr told me in the interview. currently i am holding \the mba degree and my pay is very less and the work is also not proper.is there any way that i should break the contract with the company and find the new job here in dubai with high pay will the company impose ban on me. and i have to pay the company visa charges, however the ticket expenses are born by me . the company did not pay me anything.

      1. If your visa is not stamped you can leave the job at any time no ban
      2. Company cannot impose any ban without proper proof
      3. If in case you have signed any document regarding visa charges then yes you have to pay otherwise no.

    Dear Deepak,

    I already submit my resignation and would be valid for after 30 days since I am under the unlimited contract. I already completed 1 year and 1 month (going 2 months if i finish the 30 days notice). Now they are asking me to pay the visa fees. Is it legal for me to pay this amount? and they ask me to pay 5830 after they compute the fees they costs me to be hired. They even ask me to extend for 8days of work after the validity of my resignation for me to handle the purchasing while the purchasing manager is on vacation.

      Company may not ask the employees to pay the visa fee. It is illegal unless otherwise mutually agreed and mentioned in your employment agreement.

    Sir,

    I would like to ask about what happen with my sister, she was employed as Operation Manager last May 25, 2013 at one Saloon in Al Ain however she asked her employer to go back to Riyadh, KSA coz her husband’s visa would about to expire so the Employer allowed her and bought her a returned ticket granting she would be back before their grand opening. So she left June 26 and the employer txted her nicely on the next day but after 2 days they sent her a msg that she was fired for whatever reason they manufactured. My question is does the employer has the right to terminate her at that time she was out of the country? Another thing is after a week they sent(employer) her msg to send back the original visa or else they will sue her a run away. Can this be a run away case that’ she exited nicely? Then I came and want to ask the other things my sister left in their accommodation and as a respect to her employer I send her msg but what she answered was this “don’t come to my house coz I throw her things already for a long time and if u come I will break your legs” is this right? What will I do? Is there a chance for my sister to be back to UAE? Can they impose a ban for someone who is out of the country because of false accusation? I’m waiting for you reply thank you very much,

    Good day sir! I am a salon worker as a manicurist and pedicurist. Is that really a must that we should work more than 12 hrs of work without overtime pay and without a break? And also about the verbal abuse that i am suffering right now in my manager he used to say that i dont do the work properly and as if i was playing around but sir we are working like hound dogs there is that a ground of verbal abuse ?is there any law of that especially to us working in the salon.hope you can give me advices to lessen my stress against my manager.thank you

    Sir, for semi government employees ,is it allowed to invest in any kind of establishment. By providing cheques for commercial tenancy contract (as an investor ) ,without the consent of the company , am i breaking any law and doing against the law.

    I am on my Husband’s visa holding Medical degree & working in Hospital Administration in Managerial position since Feb 2013 on 2 years limited contract & is still under 6 months probation. I had submited resignation & our HR is threating me with 1 year labour ban which they say is not revocable. My question is can my employer put labour ban on me? Even with my degree certificate & new job opportunity with 20% more salary, can I request labour dept to revoke ban?

      Hi Jenny,Since your contract is limited you need to complete the contract period other else you need to pay to the company certain amount. You will not be entitled for any gratuity. And about your new offer if It is from semi government n your visa is for direct from immigration then labor ban won’t applicable for you.

    Dear sir please give me reply i am working a retail company in Abu Dhabi my visa is three year in limited contract is finish 3 aug2013 but i want to before august regain i already give one month not-is but my hr manager is told me u brake contract u r not getting Gratuity and u pay 2000AED for visa charges please give me advise according the labor law

      Hi Sarfaraz, Yes you will not get gratuity amount since your contract is limited and you want to break it before the completion date.
      About the visa charges….unless otherwise mentioned in the contract about visa charges clause company doesn’t have right to ask employee to pay the visa charges.

    im currently employed as a housemaid in a russian family, but my working visa is as a clerk of her own company(my boss). I will finish my contract this july 2013. Can i apply another job position here in dubai without going back to my country?after i finish my contract. Can i use my one month to stay here in dubai to find another job?     i had worked in Dubai from 2003 may to 2005 feb on a 3 year valid labour visa which expires on 2006 MAY.

    But i was not able to return to Dubai due to certain family problems after a leave on feb 2005

    My sponser requested me to return back as he have no other person to continue the works which i had done

    now but naturally i am a run away person in their eyes

    after this much long time can i have to return to Dubai for any other job.

    What may be the status of my labour card earlier.

    Good Afternoon. I want to ask you some questions regarding Labour ban. I am currently working for a Contracting company in Abu Dhabi as an Accountant General under an Unlimited contract from past 7 months. My company have hired me as per my B.com degree qualification. This is my first job in the Gulf. I am looking for a job change. I have read earlier in Khaleej Times Legal View that there is no ban if an employee works for a year. However, I checked with Ministry of Labour Abu Dhabi Office and they told me that they have not come to know about anything as such and there will be a ban if an employee leave the job within 2 years of employment. My questions to you are;

    1) If I get a job now, will I be able to switch to the new company without a labour ban. If NO, then can I revoke the labour ban by paying fees to the MOL.

    2) If my new company hire me as per my SSLC/High School attested certificate with salary package of 5000 AED, then can I join the new company without a labour ban?

    3) Also, since my current company have given me Accountant General position and if the new company gives me a lower position like Accounts Clerk/Accounts Assistant/Sales Executive if they hire me as per High School certificate, will there be any problem for visa processing?

    Please clarify and advice me on the above mentioned questions since I am searching for the answers to these questions from a very long time. Your help in this will be greatly appreciated. Thank you.

      Hi Sir,

      My name is Shakir Khan. I am an Indian. I have worked for an year in an organisation here. then i resigned and went back to India for a visa change as i had been offered from another company here.
      The company gave me my appointment letter before departing.
      As of now the person hwo had interviewed me has been terminated with his whole team and the department has been shut of that organisation. And i was not informed about the same back in India. Some how i managed to get a visit visa from the company and now i am here in town but i am stressed and broken as i have no job as of now.Have been also trying other places but yet no good luck. My question is can i file a case against this company for some kind of compensation as i feel i have been ditched.

    hi i have a question about our working hours.it is stated in labor law that we have 48 working hours every week.but in salon where i work we are working 12 hours a day no special holiday off except to our normal weekly off. and during ramadan we dont have break specially us muslims. and we still work more than 12 hours that when in fact it is just 6 hours work .and i complain this to our head and i got warning.since im new among all workers in this salon i became bad to the mind of my employeer for complaining that case.and she said if we will not continue work in her salon even if we finish 2 years under unlimited contract we still under the ban of 1 year if we will work to the same nature of job.please help me clear this situation i already finish 1 year and planning to seek for better income inshaallah after 2 years of service to her.actually her offer to me when i was in my country is not the one mention in the contract although i recieve that amount instead of 1800 salary she put only 1000 in the contract and her reason just sign this paper coz this is just for your labor card requirements.am i obligue to back in my country in case i will not renew my contract to her?like what she did to my co league last month?do i have no right to apply in other salon after i finish 2 years with her?please i want to know all about this case.

    Good day to u sir! i have a problem with my employer I’m on local leave right now because i complete my 1 year and 1 months so i have the right to take my vacation leave but my employer they don’t want to give my 1 month advance salary which I’m entitled to have it.
    Their reason they will give the money unless i go to my country,but i cannot go to my country because we don’t have free ticket. Can u advice me what I will do?

      Hi Catutay, Even though you are on local leave company is paying you the salary for your leave days. This is what you are receiving leave salary.
      It doesn’t mean that if you complete one year company has to pay one month advance leave.

      Company cannot deduct the visa charges from an employee. However, if you have signed something then company has the right to deduct. Henceforth, please read all the documents carefully before signing any documents.

      You should have taken the decision before renewing the visa…..If you cancel now i think you will have a ban since it is new visa. better to check with immigration

      Hello Usman,

      Bans do not relate to Visa. Bans relate to the time spent with your employer.

      You’ve indicated that you spent more than two years with your employer so you’re not free to resign and hand your notice period

      If your employer claims you will get a ban, go to the Labour Office and they will solve it right away.

      If you’re on a freezone visa, go to Tecom and you’ll have it solved right away

I would like to ask again because I am just new here in UAE and waiting for my resident visa with my company, however my future husband will just arrived here on March 2013, is it possible that we can get marriage right away eventhough he is just in a tourist visa here in UAE? Again, what are the documents requirement in getting marriage here in UAE? Is it also safe for the labor law that once we get marriage here and got pregnant here in UAE,is it possible that I will give birth here in UAE?

      1. I dont think you can get marriage having visit visa….pls confirm with court or church (if you are a christian)
      2. About Documents you need to check with court/Church
      3. If both of you have residence visa and attested marriage certificate you can give birth here.

      1 You can’t get married if both parties are not UAE residents

      2 If you get married in your country, then you can bring him her on a resident visa sponsored by you but he can’t work

      3 Documents will be, Marriage certificate, if from your country stamped by embassy, passports

      4 Yes you can get pregnant here. AS long as you’re married to him, whether on tourist or resident visa you can give birth.

    hi deepak, i have a question regarding my friend, she is in 24-hr service in a home care, basically she is a nurse, at first their contract was merely a normal working hours, but then when she was transferred to a 24-hour basis, which is stay in with the patient in their house, she signed new contract saying that whoever will resign from the company will pay 15,000 aed penalty. The thing is the agreement working hours is 16 hours, but what happened is she cannot rest very well because of some cases of the patient, there is no exact provision and policy regarding the working hour and time of rest by their nurses under 24 hrs, though it was paid but 75 dirhams per day plus 2500 basic is not enough. considering the risk of illness that she might get if she couldnt get enough sleep at night and the risk of ill patient with her, her safety is at risk. what could be the ground if we want to raise this in labor?thank you so much

      there are 2 options. One is marriage in Church(as per your religion). other option is court marriage.
      I suggest you to have court marriage in addition to religious marriage. This ensures your marriage is legal in UAE.
      One more important thing is: Do not forget to invite me!

    i have recently got an offer letter from an company based on previous medical report & security clearance from UAE govt, so myself accepted & signed the offer letter & resigned from my old company . Now i reported to my new company office on 4th feb 2013 as per the offer letter & now the company is saying that they did a mistake by offering me an offer letter based on my previous medical , the company policy is to carry out an company medical first & than give an offer letter to the new employee.

    Kindly suggest what happens if

    1) Myself fail the company medical examination.???
    2) Does this initial offer letter has any terms & agreement.??

    I completed my 1.5years on december in a company in Dubai and I applied for a leave for 45 days.For an emergency I released my leave salary when I complete my 1year.Now the problem is that they are permitting only 19days leave and they are telling that as per law when I withdrawn my leave salary the leave was cancelled.So Is there any UAE rule like this.Can you give that clause no.

    Can my manager ban me if ever i will resign now? I asked my co worker and what He said is that I can leave my company anything without paying or ban because I already finished my contract and renew it last March 2012….

    Good day Mr. Deepak,

    My employer terminated me with-out giving any notice or warnings. When I asked them why did they terminated me, they said that the department do not like me anymore and they gave me two option, its either I resign or they will just declare me as an abscond but i did choose any of there option. The next day I went to there office and informed them about the Dubai labor law section 1 article 115 and article119. Because of that they gave me 3063.00 durhams only. now I want to claim for my service charge since I’m working i a hospitality industry but they did not gave it. Can I force them to pay me about that? please advice me what to do because I’ jobless now and I have four little children..

    Hi,.Mr. Deepak .. I work in JLT free zone company..My salary is 12k . I joined in October 2012 .. Am not working in my core technology , so I want to resign or change my job .. Is there any ban for me ? ..When I signed my dmcc contract it mentioned as oct2012 -oct 2014 .. But I asked my MD u didn’t tell anything about this contract.. MD replied its DMCC and its for all ..incase if u r not interested u can submit resignation before a month.. question 1. is there any ban for me ? 2.. if I go to my country with out cancelling my visa ,shall I come back to uae ?

      If you have master degree plus 12 k salary then there wont be a ban
      if you go to your country without cancelling the visa for sure company will put under absconded list

    Dear Deepak,

    I am working as an Accounts Manager in LLC company in dubai with unlimited contract with a Basic Salary of AED 5,000/- + 3500/- allowances per month since 19th December 2011. Now i got a good job in Medica City with Basic Salary 4,250/- + allowances 4,250/- and i resign from my current job on 3rd November 2012. But company is saying you can not leave because of year end you must finish the closing of the books of accounts and your replacement will come than only you can go. Company is running in loss from last 4 years and they are not paying salary and supplier payments in time. I have family problems that the reason i take the step and find a good job and resign from this job. Please give your valuable suggestion in this regards.

    1 Can company hold me to work if i don’t want to work .
    2. is there any rules i have to finish the accounting year and after i should leave the company.
    3. My 30 Days notice period will complete on 2nd December 2012 what i should do if they will not cancel my visa and not accepting my resignation.

      Regarding Ticket yes you need to pay because it is a resignation. And about visa charges , if it is mentioned in your employment contract and you have signed it then you have to pay the same.

    i am thai lady came to work here as a waitress already 1 year with visa limited of contraction 2 years,the company brought me here and provide 2 way air ticket,transfer and accommodation.my basic salary is 1000 +allowance 250 +tip guarantee 1000=2250 dhs
    because the company announcement this..
    1 vacation the stuff need to be guarantee pay up 8000 +holding 1 month salry+signature guarantee.
    2 if stuff resign before the completion contract they must pay cash 12000 dhs.
    i have to finished the contract but
    what about the labor law said?
    what can i do with the complaint and should i forget about to go visit parents ?

      There is nothing like that but you need to go as per the contractual terms. If it is stated that you will get air ticket after completion of two years then you will have ticket only after two years.
      In case of emergency you can go to your home country bearing ticket expenses of your own. But to resign you need to complete your contract period.

    Dear Deepak,

    I was working on an ‘initial’ limited contract term of 2 years. Due to a medical concern I resigned giving the required notice period and asked to take my annual leave (22 days) in order to complete my two year contract, which was granted. As the completion date fell in the beginning of the month my employer also offered me additional unpaid leave in order for me to have medical coverage for the remaining month which was very kind.

    When I wanted to collect my final pay no gratuity was included and I was told I have no entitlement…

    Does the entitlement of finishing a two year contract (21 days per year) vanish if days worked for the company including paid annual leave exceeds the 730 days ( 2 years) by one week??? I did not considered the unpaid days.

    I have not accepted final pay check but would need some guidance on my rights.

      If you have limited contract you need to complete the contract period to receive your gratuity.For sure unpaid leaves will not be taken into consideration while calculating gratuity. If you have completed your contract period then you are entitled for the gratuity.

    Read the law, and have a querry, I have an employee who has a 3 year limited contract (joined in 2010), he resigned at his will at end 2 years. Is he entitled to gratuity?? How valid is article 138 in this case?

      He is not entitled for gratuity since it is a limited contract he has to complete the contract period. This is what I guess.

    Hi deepak,

    I am under unlimited Dubai Visa, my contract is 2 years i serve the company for 1 year and 6 months, still i can get a gratuity?

    I have given my resignation notice period last Oct 1 and our HR told me that my last day will be Oct 11. how much computation will i get.

    Actually i am waiting for my final settlement usually how many days the computation will get done.

      Yes you are entitled for gratuity. You will get your gratuity till your last working day.

    Hi Deepak,

    The law mentions the word salary a few times. However, it doesn’t specify whether that includes the total salary with the housing or if the housing is considered separate. The context of my question relates to the end of service benefits since it makes a big difference.

    Another question is on how half years are calculated. Are they considered or does the year need completion for it to be taken into account?

      Gratuity is calculated on the basic wage last paid to the employee prior to termination of the employment contract and this wage is the basis for calculating the gratuity for each year of employment.

      An employee has completed one year and more in continuous service they are entitled to gratuity as a percentage of the year proportional to the duration of their service.

    i am working in UAE salon from may 2011, i have two years contract and my visa is limited. my salary pakage is too poor i want to change my job i have degree of bachelor and my masters degree is under process i want to work according my degree so please tell me what are the possibilties and requirements to change my work. thanks

      Once you completed your contract and once you get your new masters degree you can search for the job which matches your profile. Would suggest you to be on the current job to avoid ban.
