UAE Labour Law 2012-Download PDF

UAE Labour Law encompasses all the rules and regulations with regard to the laws related to the employment in the UAE. Everyone who is employed in UAE should make it a point to read this law to understand their rights, their employer’s right, various laws on gratuity calculation in UAE, dispute resolution and so on.

I believe that the UAE Labour Law is prepared by Ministry of Labour to protect the rights of the employees as well as employers.

    Hi Mr.Deepak, I am working in unlimited contract from past 5 months now I want to leave the company and this is my second job I hav completed one 2 yrs contract before. am a graduate so, if I leave d company will I have any kind of ban pls reply..

      HI Abdul,Yes there will be a labour ban you need to complete atleast one year in the company

    i am working in a company in dubai (freezone) since feb 2013 and my boss is terminating me with 15 days notice without proper reasons. Is there anything i can do to escalate this to a higher authority. I am on probationary period.

      Hi Rachel, The company must have not satisfied with your performance and company has the right to terminate your contract without giving notice. Sorry in this matter you cannot do anything.

          Hi Emily,Because you might be on probation period or You might have done any act under the article no 120 as per UAE Labour Law

    Dear sirs / madam,
    I’m working in a company here in dubai, and my contract period is 4 years but my visa expires in 3YEARS but now I don’t like to continue with this company I have given my resignation they approved also but they are asking me to pay 45 days salary as per the dubai labour and law..is there any rules like this?? Please help me…and also I told I don’t want any gratuity please reply me..

      Hi Crish, Yes if it is limited contract and incase you are breaking this contract you need to pay the company .

    Dear sir please give me reply i am working a retail company in Abu Dhabi my visa is three year in limited contract is finish 3 aug2013 but i want to before august regain i already give one month not-is but my hr manager is told me u brake contract u r not getting Gratuity and u pay 2000AED for visa charges please give me advise according the labor law

      Hi Sarfaraz, Yes you will not get gratuity amount since your contract is limited and you want to break it before the completion date.
      About the visa charges….unless otherwise mentioned in the contract about visa charges clause company doesn’t have right to ask employee to pay the visa charges.

    Good day,
    im currently employed as a housemaid in a russian family, but my working visa is as a clerk of her own company(my boss). I will finish my contract this july 2013. Can i apply another job position here in dubai without going back to my country?after i finish my contract. Can i use my one month to stay here in dubai to find another job? Please tell me what im going to do. Thank you for your time. More power!

    i had worked in Dubai from 2003 may to 2005 feb on a 3 year valid labour visa which expires on 2006 MAY.

    But i was not able to return to Dubai due to certain family problems after a leave on feb 2005

    My sponser requested me to return back as he have no other person to continue the works which i had done

    now but naturally i am a run away person in their eyes

    after this much long time can i have to return to Dubai for any other job.

    What may be the status of my labour card earlier.

    Dear Deepak,

    Good Afternoon. I want to ask you some questions regarding Labour ban. I am currently working for a Contracting company in Abu Dhabi as an Accountant General under an Unlimited contract from past 7 months. My company have hired me as per my B.com degree qualification. This is my first job in the Gulf. I am looking for a job change. I have read earlier in Khaleej Times Legal View that there is no ban if an employee works for a year. However, I checked with Ministry of Labour Abu Dhabi Office and they told me that they have not come to know about anything as such and there will be a ban if an employee leave the job within 2 years of employment. My questions to you are;

    1) If I get a job now, will I be able to switch to the new company without a labour ban. If NO, then can I revoke the labour ban by paying fees to the MOL.

    2) If my new company hire me as per my SSLC/High School attested certificate with salary package of 5000 AED, then can I join the new company without a labour ban?

    3) Also, since my current company have given me Accountant General position and if the new company gives me a lower position like Accounts Clerk/Accounts Assistant/Sales Executive if they hire me as per High School certificate, will there be any problem for visa processing?

    Please clarify and advice me on the above mentioned questions since I am searching for the answers to these questions from a very long time. Your help in this will be greatly appreciated. Thank you.

      Hi Sir,

      My name is Shakir Khan. I am an Indian. I have worked for an year in an organisation here. then i resigned and went back to India for a visa change as i had been offered from another company here.
      The company gave me my appointment letter before departing.
      As of now the person hwo had interviewed me has been terminated with his whole team and the department has been shut of that organisation. And i was not informed about the same back in India. Some how i managed to get a visit visa from the company and now i am here in town but i am stressed and broken as i have no job as of now.Have been also trying other places but yet no good luck. My question is can i file a case against this company for some kind of compensation as i feel i have been ditched.
